The trial of former Rutgers University student Dharun Ravi has begun. Ravi faces 15 criminal charges, including bias intimidation and invasion of privacy, stemming from accusations that he used a webcam to view his roommate's intimate encounter with another man. NBC's Craig Melvin reports.

Updated at 1:40 p.m. ET: NEW BRUNSWICK, N.J. - Opening statements Friday in the trial of a former Rutgers student accused of using a webcam to spy on his roommate's intimate encounter with another man focused on whether the defendant was malicious or just an 18-year-old boy acting his age.

First Assistant Middlesex County Prosecutor Julia McClure told jurors that Dharun Ravi deliberately planned to invade Tyler Clementi's privacy "and to deprive him of his dignity."

Defense attorneys countered that Ravi, 18 at the time but now 19, behaved childishly but did not commit any crime. He faces 15 counts of invasion of privacy, witness and evidence tampering and bias intimidation, a hate crime punishable by up to 10 years in state prison, in New Jersey's Middlesex County Court.

"He may be stupid at times," said Ravi's lawyer, Steven Altman. "He's an 18-year-old boy, but he's certainly not a criminal."

The case started a national conversation about how young gays are treated after Clementi committed suicide in September 2010.

"The defendant's acts were not a prank, they were not an accident and they were not a mistake," McClure?said. "They were mean-spirited, they were malicious and they were criminal."

In her half-hour opening statement, McClure did not mention?Clementi's suicide.

Ravi reportedly sent Clementi conciliatory texts

'Not anti-gay'
Altman said Ravi was not bigoted and never bullied Clementi.

"You're going to see evidence that Dharun is not homophobic, not anti-gay. Evidence that he never recorded, never broadcast images of his roommate. He never harassed his roommate, or ridiculed or spoke negatively about his roommate. He thought he was nice guy and had no problem with him," Altman said.

Altman said his client saw only seconds of images of Clementi and another man hugging.

It took four days to seat a jury of 16, including four alternates, in a case that's made national headlines.

The trial is going forward because Ravi rejected a plea bargain offer that would have let him avoid any jail time and receive the state's help if federal authorities tried to deport him to India, where he was born.

If the other man in the video is brought to the witness stand, his testimony could become a key part of the trial. He's been identified publicly only by the initials M.B.

The trial is expected to last three to four weeks.

The main alleged crime happened just weeks after Clementi, a violinist from Ridgewood, N.J., and Ravi, an Ultimate Frisbee player from Plainsboro, N.J., moved into their dorm room at Rutgers.

Clementi's parents said he told them he was gay in the days before he left for Rutgers. But court filings show that Ravi already knew that from Clementi's Web postings.

Authorities say Ravi used the webcam on his computer to check on Clementi when he'd asked to have the room to himself so he could have company.

Ravi posted a Twitter message about it: "Roommate asked for the room till midnight. I went into molly's room and turned on my webcam. I saw him making out with a dude. Yay."

Pal takes plea deal
Initially, another first-year Rutgers student, Molly Wei, of Princeton Junction, was also charged in the case. But she entered a pre-trial intervention program last year that allows her to avoid jail time and emerge without a criminal record if she meets a list of conditions for three years. She also agreed to cooperate with prosecutors in their case against Ravi.

Two nights after the first alleged spying incident, authorities say Ravi tried to do the same thing when Clementi asked him to stay away from the room again.

A day after that, Clementi jumped from the George Washington Bridge, leaving behind a terse Facebook status updated: "Jumping off the gw bridge, sorry."

The trial is expected to delve into text messages, tweets and online chats from Clementi and Ravi.

"For the first time in history, we have the technology available to broadcast the findings of an expedition through Google. Millions of people will be able to experience the life, the science and the magic that exists under the surface of our oceans," says the survey's chief scientist, Ove Hoegh-Guldberg of the University of Queensland in Brisbane.

Triple choice

So far, only a few sample, limited surveys have been undertaken. These are now online and viewable at seaview.org. The project proper kicks off in September, when three surveys begin at 20 points around the 2300-kilometre long reef. Footage from each site will be posted online as the surveys progress.

These comprise a shallow reef survey using a 360-degree camera on a motorised diver-pulling underwater "scooter", a deep reef survey ploughing the depths between 30 and 100 metres using robotic submarines, and a megafauna survey studying the migratory behaviour of tiger sharks, green turtles and manta rays as seawater temperatures increase.

To give deskbound divers a 360-degree view on the web, the camera work is a real challenge, says Richard Vevers, founder of Underwater Earth, the group handling the diving, submarine robots and all camerawork for the survey.

"Issues with water clarity, low light conditions and light distortion underwater called for a very different camera set-up to Street View. The development of the camera has been carried out independently from Google using underwater photography specialists. The result is a very different panoramic camera," says Vevers.

Multiple angles

One camera uses four SLR cameras with extreme fish eye lenses shooting simultaneously to give the full 360-degree image. One of the cameras on the scooter points directly downwards, photographing the surface that the reef is growing from as it travels along.

For those who don't want to steer around a panoramic web page, there are also plans for video capture at each reef location for screening on YouTube ? where a bespoke channel is being developed by Google.

"We are also already looking into a 360-degree panoramic video version of the camera, however due to the extremely high volume of data that this involves, further developments are needed in technology before this information could be made accessible online," says Vevers.

Damage checker

The survey data is expected to be useful when the reef is damaged ? by ship groundings, cyclones, bleachings and pollution events ? and Vevers says the Great Barrier Reef Marine Parks Authority is be interested in visualising such damage with the surveying equipment.

After trying out the virtual dive, Buki Rinkevich, a coral reef expert with Israel's National Institute of Oceanography in Haifa, is impressed. "This virtual dive in the reef is a fascinating experience that may well bring their 3D beauty to the public," he says.

In future, he would like to see the Catlin team give viewers the option of revealing more information about marine life, coral polyps and other reef structures in shot to add to the educational aspect.

Personal Branding For Business ? Brilliant, Not Backwards ? oracle ...

Personal branding, the science of establishing a brand identity for individuals, usually related to career/professional development.? The personal brand idea is taken from what companies have been doing since the dawn of capitalism, and an individual uses these principles to find a way to stand out from the crowd, figure out what value he or she adds, presenting a consistent personality online to develop a reputation in this space of too-much-information.

I?ve been reading quite a bit about personal branding lately; as a marketer, it fascinates me.? And I realized that some of the tenets of this practice are employing major principles of marketing that have atrophied in business, principles which need to be reexamined if brands are going to survive.

The following is a list of 10 reasons individuals, especially job seekers, should be concerned with personal branding.? It comes from personalbrandingblog.com, the brain child of Dan Schawbel, one of the current proponents of the field, and author of Me 2.0.? I took these principles and turned them right back around to business branding, because businesses often seem confused in their Web content and social media strategy, as well as branding as a company-life-long effort. Which technologies to use?? What kind of content?? What does our audience want from us??? The information below is taken directly from Schawbel?s blog. I?ve added my comments in italics.

?1. Generations are colliding online

Facebook started out as a hang out place for college students, but now we?re seeing older generations adopt social networking. Social networking use among internet users ages 50 and older nearly doubled?from 22% in April 2009 to 42% in May 2010. This means that communication between age groups is occurring more and more each day, and your audience is changing rapidly. Entire families are interacting online and 70% of parents friend their kids. You have to be aware of your audience and the content you?re publishing because if they don?t match, it can have a negative effect on your personal brand.

Understand your audience. What are the demographics of the largest portions of your customers?? Don?t exclude older users from technology tools, including social media.? And consider your content and how it relates to them.?

2. Your online reputation can make or break you

Your brand is on the line, wherever your name and face is seen. Clients, managers and other professional stakeholders in your life have access to what you post publicly on the net. You can even lose your job over blog comments or attacks from people that already have a negative view on your reputation. For instance, Madhu Yarlagadda was hired by Skype as the new Chief Development Officer, and after a TechCrunch blog post, people came out of the woodwork to expose Madhu. Skype replaced him after a month of employment?.

The brand of your employees matters as much as your company?s brand.? You must consider what your people are publishing, and encourage them to develop their own brands as experts in your industry, especially the execs.? And watch out for negativity.? Have policies in place about commenting or responding on blogs!? Transparency is great for business, so you don?t want to have too many watchdogs, but there ought to be some guidelines for avoiding bad publicity traps.

3. Employers are reviewing your online personal brand ?

Almost every website on the planet has a search engine component to it and employers are using them to find more information about you.? Make sure your personal brand is consistent and up-to-date.

Make no mistake, people are Googling your company.? With the dollar tighter than ever, people want to know they?re making the right choice when they spend their money.?? Check your Google results, and your online reputation.? Make sure it?s consistent with how you want to be perceived. The challenge is always aligning audience perceptions with your own, and how you wish to be seen.? It?s a give and take, but you can help it along with the right Web content, professional profiles, and SEO.

4. Perception (how we present ourselves) is king

It?s the little things that count, whether you?re in an interview, or interacting with people online. A CareerBuilder survey states that 67% of hiring managers say that failure to make eye contact would make them less likely to hire a job candidate and 38% said lack of smile. People will judge you on small things that make a big difference. By being professional, using good eye contact, shaking someone?s hand, having good posture, and using appropriate images online, you will be more successful when communicating with others.

Your customers will judge you on the small stuff, too.? Make sure you?re portraying your brand in a light that engages with your particular audience.? Know who that is.? If it?s a family friendly atmosphere you want, smile in all your photos, talk about your kids in your blog posts, and provide Web content related to child safety or education.? People need to perceive that you are who you say you are, and the tone in your blog and even the way you answer the phone matters.? Tell your employees to always answer the same way, with a smile ? others can hear it.?

5. Stay relevant or stay unemployed

You need to be relevant to be desirable in the marketplace. The U.S. Department of Education estimates that 60% of all new jobs in the twenty-first century will require skills that only 20% of current employees possess. You need a sense for what skills are important in your industry, and which ones might be significant in the future. By keeping yourself relevant, you?re keeping yourself employed. For instance, if you?re in the marketing world, you can?t avoid online advertising, and mobile applications.

Keep up to date with your company brand, evaluating and checking in every once in a while.? Survey the competitive landscape and make sure the skills, values, and method of service your company provides is in line with what consumers want.? This includes new technologies, if they are appropriateyou?re your audience.? Stay relevant.? Showcase these updated skills on your Web site, blog, and social media campaigns.

6. Job searching has been replaced by ?people searching?.? If you apply for a job through a job board, you will be disappointed.

[?]As you progress in your career, networking becomes more important because it?s almost 100% a hidden job market when you?re an executive job seeker.? Your best bet is to focus on building an enormous Rolodex throughout your career, giving value to them, and then asking for help when you need it.

Networking, we all know, is as important for client management and growth opportunities for business as it is for individuals looking for a job.? Make yourself visible in the community, and get out there every once in a while.? Even with more technology involved in the workplace, it?s still about the people.? Collaborate with other organizations that serve the same population and grow your network exponentially.? Volunteer for committees or nonprofits; go to the Chamber of Commerce meetings.? Circulate!

7. You have to stand out, to get noticed, and uncover opportunities

People are starting to go to extreme lengths to stand out in this crowded world. ?[T]here are a lot of things you can do to build your personal brand and get attention. For instance, creating a video resume of yourself and sending it to a hiring manager is one way to get through the noise. Also, having a blog that depicts your human voice is a great addition to a stale resume that employers don?t trust anyways.

Do something to get attention.? Guerilla marketing tactics work.? Make a splash.? Buy a town, like?Half.com?.? Let loose thousands of bouncy balls down the hills of San Francisco, like Sony.? Hold an event in collaboration with other businesses, organizations, and individuals in your community ? with beer trucks and Sufi dancing.? Start a program for kids. ?Accept video submissions from customers and put them on your site. ?Inject some real personality into your blog and stop playing it so safe.? You can?t appeal to everyone, but those you do appeal to will respect you more for taking a stand and being creative.

8. You have to specialize

You need to be known for something and don?t try to be everything to everyone. Being a generalist will help you adapt to new jobs because the market changes all the time, but specializing will make you more desirable to hiring managers. In fact, 71% of hiring managers are looking to fill ?specialized positions? while 61% of job seekers considered themselves to have ?broad skill sets?. Companies are looking to hire experts in their fields to solve real business problems. Become an expert in an in-demand field and you will have leverage over the recruitment process, make more money, and secure a stable position.

You have to choose.? As in #7, you can?t appeal to everyone.? And Wal-Mart?s already been done.? As a business, if you can find a niche that you fill better than anyone, you have a better chance of surviving in today?s marketplace.? Can you specialize your service or product?? How about your audience?? Do you make auto equipment?? Can you get a booth at all the retro car shows and become known as the antique vehicle collector?s place to go?? Are you in technology?? Can you focus on the Web developers specifically, or the field of Healthcare IT? Make sure your target audience is growing, or big enough to sustain you.? People have made businesses out of some pretty specific niches.? And determining your Web content is easier when you?re specialized.

9. The competition is relentless

The competition we?re facing online is getting tougher by the day. There are 75 million people on LinkedIn, 150 million blogs, 500 million people on Facebook, and 200 million people on Twitter. With the amount of noise/content available now, you have to work harder, faster, and smarter to get your name out there. People who have known brands in their industry will flourish because people already know, like and trust them. Everyone else has to put in the effort to build a brand that can compete?

We?re well aware of the white noise out there, especially online.? But if your brand is not known, you?re going to have to work at it to avoid being drowned out.? This is why truly understanding your audience, your mission, and your brand personality is important.? It will help you stand out and keep from being another business doing the same old thing.? Don?t be noise ? say something important with your work.? What?s your mission statement? If it?s boilerplate, revise it.? Make it count and get your brand out there.

10. Interpersonal skills are becoming more valuable

A brand requires a personality if it?s going to be distinctive. Your personal brand needs to be personable and attract positive attention. Organizations are starting to place a higher value on interpersonal skills (communication, teamwork, organization) and cultural fit, instead of technical skills and experience. Technical skills and experience are easily replaceable in most fields, but it?s harder to replace people who fit perfectly in your organization and work well with your current employees. A new survey by Right Management shows that 31% of companies feel that organizational culture and motivation fit is important, while only 12% are for technical skills, and 11% are for relevant experience.

What?s your corporate culture?? You have one, but if you don?t know what it is, you may want to take some steps to shape it.? People pay attention to your culture and its consistency with your overall brand image.? Does it mesh?? If your mission is to help others, are your employees allowed volunteer time each month?? If you?re a green energy-saving business, what do you do in-house to stay green?? Are you LEED certified?? Do you have a compost pile or all LED lighting? Again, what does your audience want from you? Give it to them.

In addition, positivity and personality should be showcased throughout company/customer communications.? Establish a voice for your blog and social media and keep it consistent.?

Follow these 1o tenets and rise to the top of the heap ? and the Google search results?.

Glasses Can't Fix Short-Sightedness | The Social Customer

In this day and age, in an economy that is showing signs of staggering back to its feet, in a world where competition for the entertainment and hospitality dollar is wide and varied, it is amazing to me that establishments that cater to the public can provide ridiculously poor service, at any time. ?But when poor service is mixed with bad attitude?and stupidity, that my friends is the golden trifecta.

My colleague Jaime is president of the American Marketing Association of Southeastern New England, (AMASNE) and in the role, frequently hosts networking events with a substantial number of people who, not surprisingly,?market for a living.

So an event is held at STATE Ultra Lounge, apparently one of Providence?s hot spots. ?When Jaime called that morning to confirm, they asked if she would, umm, reschedule her event. After Jaime gently but firmly convincing them to honor their agreement and open for the sake of preregistered guests, STATE ?charged Jaime?s group an outrageous sum of money for less-than-exquisite hors d?oeuvres such as?chicken fingers and pigs in blankets that could have easily been purchased from BJ?s for $20. Jaime told me ?As a business owner and marketing professional, I am bewildered and appalled.?

And here is that three-way intersection of crap service, attitude, and ignorance. STATE was mad that they had to open their doors when they otherwise would not. ?AMASNE had a small but dedicated following who had already registered, but apparently not a big enough group to satisfy STATE so they gouged on the food deal. ?Duh. Not exactly the way to treat a room full of marketers. ?People who influence buying decisions, for a living.

So because of this incident, it goes without saying that AMASNE is not planning on any?further?events ?at STATE, nor will any of the group of marketers who attended the event likely be spreading any good words about the Ultra Lounge.

Now, I?m no genius (you?ve probably noticed), but it seems to me that if a restaurant / lounge / bar / whatever? is reserving a room for a group of marketing professionals, you might want to do something to ensure that they have a great freakin? time. ?Because if you DO ensure that they have a great freakin? time, then they will send traffic your way. ?Not interwebs kinda traffic ? real traffic! ?People with money traffic. ?

Let us consider for a moment that a personal recommendation is twice as?influential?as even the best advertising, and even an impersonal recommendation (from a stranger) is 50% more?influential.

So this was what the young folks call ?an opportunity? ?for STATE. ?A really nice one, served up on a silver platter.

And they blew it.

Cannot get Venture Capital? Look At These Two Options

Many business owners try to finance their growing businesses by going to venture capital or angel funding groups. Although both financing options provide a great way to finance a business, they are usually hard to qualify for. And furthermore, they all require that you give up some business equity in exchange for funds. That, needless to say, can be a very steep price to pay.

There are some business financing alternatives that can allow you to finance your business, almost as effectively, without having to give up any equity. As opposed to venture funding or angel funding, these options are easy to qualify for and do not require the endless documentation and due diligence that venture money requires.

However, these can only help you if you meet the following criteria:1. Your business is established and has commercial (not consumer) clients

2. Your business invoices between K and 0K per month

These alternatives will help you if:1. You need money to meet payroll, pay rent or pay suppliers

2. Your customers pay you in 15 to 60 days

3. You need (or wish) your customers to pay you sooner

Your first option is called factoring (also known as invoice factoring). Factoring is ideal for businesses that cannot afford to wait 15 to 60 days to get paid by their clients. Factoring provides you with financing that is tied to your invoicing. Basically, the more your company invoices, the more financing you qualify for. This enables you to grow your company ? many times exponentially ? without having to give up equity.

Your second option is called purchase order financing. It works well for re-sellers, distributors, traders and wholesalers. Purchase order financing is ideal for business owners that have a large purchase order in hand, and who cannot afford to pay their suppliers to deliver the product. PO financing enables you to get a letter of credit, backed by the financing company, to pay your suppliers. This allows you to deliver on the purchase order and effectively make the sale. Usually, very little ? if any ? of your money is required for the transaction.

Both alternatives are easy to qualify for, take days (or a couple of weeks at most) to set up, and when used correctly allow you to grow your company exponentially.

Those Who Can't ? Self-Publish. Really? | Marcy Kennedy & Lisa ...

A lot of people put ?write a book? on their bucket list. Thanks to Amazon, Smashwords, and fee-based publishing companies, having a book with your name on the spine is easier than ever. There?s never been a better time to be an author, never been more options, but simply being published means very little now.

When everyone is special, then no one is.

The Author Is Now In Control
Authors are entrepreneurs. Gone are the days of the solitary writer holed up in a writing cave never interacting with readers. There?s no longer a stigma attached to self-publishing, the stigma is attached to books that do poorly. Your book must earn respect now with sales and Amazon rankings determining value, not the name of the publisher on the spine. Indie and self-publishing avenues (digital especially) have leveled the playing field. But with privilege comes responsibility. For the first time writers have choices ? you can traditionally publish or self publish or both, but either way the burden of responsibility for success rests with the author.

A Leveled Playing Field
Traditional publishers have always offered distribution, something authors couldn?t get anywhere else. The cover art, editing, interior design are all services that many publishers are outsourcing anyway, but with digital there?s no longer any need for distribution. Barry Eisler made publishing news a few months ago when he turned down a BIG (I mean, never have to write again big) deal from St. Martin?s Press. He was then approached by Amazon to publish with them first digitally and then in paper at a much higher royalty rate. He didn?t need either St. Martin?s or Amazon for distribution ? he already has a substantial platform, but Amazon offered direct to consumer marketing he could tap into. At the Writer?s Digest Conference (WDC) in New York, Eisler claimed he?s made more on the book published with Amazon, than on any of his traditionally published books. Self-publishing was the smart business decision for him.

Writing Is A Business
Traditional publishers typically offer 17.5% royalty rates, but with self-publishing authors keep upwards of 75% royalties. Writing is a business and the business is connecting with readers. Traditional or self-published doesn?t matter because the self-published or indie author can hire an editor and the same cover designer as the big publishers, and put out a comparably packaged product. But not all books are created equal ? and whether you?re self-published or traditionally published, failing to connect with readers will be reflected in customer reviews and sales numbers. Just putting a book out there doesn?t mean anyone will buy it ? or find it in this crowded marketplace.

A New Business Model
A new business model is emerging. Previously, a traditionally published author would put out 1 new title a year (or less than that), and then build a speaking and teaching career beneath the writing career. Indie publishers are telling new writers to publish 3-5 books a year to keep readers coming back. Writers must be entrepreneurs. Many of the successful independent authors have a team of writers writing for them ? their name has become a brand ? almost like a fashion label. But this also opens up markets where previously there were none ? like short stories and poetry.

In Summary
If you don?t have a top-notch product (book), don?t have great packaging (interior design, cover art, binding, cover copy), and a social network who will share and recommend your work ? you?re playing the author lotto (and the odds aren?t in your favor).

The average self-published title sells 80 copies. You can?t live off that. But the good news is that those are all things you can control through hard work. It?s a lot of trial and error, learning from what didn?t work as much as what did. These authors spoke of testing titles with Facebook ads, and monopolizing a word through Google ads. It?s a serious, purposeful business model being planned up to two years in advance.

Being traditionally published gives you instant credibility with retailers and to a certain extent readers, but that?s overcome with reader reviews, blogger reviews, Amazon rankings, etc. This is a really exciting time to be a writer. Authors no longer need the brick&mortar bookstore, the agent or New York publisher to be a success (whether publishing digitally or not) and that?s changed a lot of things.
